What data is collected when you visit this website, who else gets to see it besides us, and what you can do about it.
This policy is a draft and does not replace legal advice. Before going live, it should be reviewed by a lawyer, along with the question of whether a representative in the EU is required for visitors from the European Union.
The dashed placeholders mark information that only the owner can provide. They remain visible so that no one overlooks them.
Which law applies
We are based in Basel, so Swiss law applies first and foremost. The relevant law is the revised Federal Act on Data Protection, known as the FADP, which came into force on 1 September 2023.
Basel lies in the tri-border region. The German and French borders are only a few kilometres away, and a visitor from the European Union is not the exception here but the rule. For such visitors, the European Union's General Data Protection Regulation, or GDPR, additionally applies. We therefore follow both sets of rules and state in each case which one we mean.
Who is responsible
Responsible for processing your data is the operator of this website. Its registered name has not yet been finalised and is therefore left open.

What is collected when you visit this site
Like every website, this one also runs on a server, and that server keeps a log. This happens automatically, before we become aware of it at all.
Such a log typically records: the IP address of your connection, the date and time of access, the file retrieved, the amount of data transferred, the browser used along with its operating system, and the page you came from. We use this data only to operate the website and to fend off attacks. We do not combine it with other data, and we do not try to identify a person from it.
Which fields are actually stored and for how long depends on the hosting provider. This has not yet been decided.

No tracking, no advertising cookies
No analytics tool runs on this website. No Google Analytics, no Facebook pixel, no heat map of your mouse movements, no advertising networks. We count neither visitors nor clicks.
Nor are any third-party servers embedded. Fonts, images and scripts are hosted on our own server. As a result, simply viewing these pages does not create any connection to Google, to a font service or to an advertising network. A connection to the outside is only made once you press a button yourself, for example the one for WhatsApp.
We do not set cookies, except those that are technically necessary to operate the site. That's why you won't see a consent banner here either. There would be nothing for you to consent to.
The cart is stored in your browser
If you add a unique piece to the cart, this is stored in your own browser, in what's known as local storage. This list stays on your device. It is not transmitted to us unless you actively submit it, and we cannot read it.
You can delete the list by removing the pieces from the cart again, or by clearing the website data in your browser settings.
WhatsApp as a way to contact us
Many people send us a photo of their jewellery first. This is convenient and we recommend it. But you should know what happens when you do.
WhatsApp belongs to Meta Platforms. If you write to us via WhatsApp, your phone number, the time, the photo and the content of the message pass through this company's servers. This data leaves Switzerland in the process, among other places to the United States. What further information Meta collects about you is determined by Meta, not by us. We have no influence over this.
If you'd rather not, just call: 077 996 60 01. A phone call goes through your telephone provider, not through Meta. Or drop by without notice, Monday to Saturday 10:00 to 20:00.
We keep messages that reach us via WhatsApp for as long as we need them for the enquiry. If you then sell us something, the statutory retention period applies to the related documents.
The shop and Shopify
In our sales section we show unique pieces that we have bought. A shop system is planned for the ordering process, and this has consequences for your data.
Today, the list of pieces runs from our own server. Reservations are made by phone or WhatsApp, and no payment takes place on this website. In this state, no order data is sent to a third-party provider.
This will change once checkout runs via Shopify. Shopify operates servers outside Switzerland. The order, delivery address, email address and payment details will then be held there and not with us. In this case, Shopify is our processor under the FADP and our processor under the GDPR. A corresponding contract and a review of the data transfer abroad need to be completed before the shop goes live.
We will tell you on request which of the two states currently applies. Once the shop goes live, this section needs to be updated on the same day.
If you send us goods by post
When buying by post, we need more from you than in the shop, because you are not standing in front of us. What exactly this is set out here, and how the postal process works is explained on Sell gold by post.

An ID number and a copy of an ID are particularly sensitive. They make it possible to uniquely identify a person, and they can be misused. That's why we keep these documents separate from the rest of the post and only pass them on if a law or an authority requires it.
If the opening of a parcel is recorded, this creates a video recording of your shipment. Whether we do this, how long such a recording is kept, and who may view it has not yet been decided, and is therefore listed above as an open item.
Who else gets to see your data besides us
We do not sell any data and we do not pass any on to advertisers. The following parties get to see something because it isn't possible without them.
- Hosting provider
- {{HOSTER}} operates the server this website runs on and keeps the log.
- Meta
- Only if you write to us via WhatsApp. Anyone who calls or drops by does not appear there.
- Shopify
- As soon as checkout runs via Shopify. Not before then.
- Authorities
- When a law obliges us to, for instance under the Anti-Money Laundering Act or towards the tax authorities.
Your rights
Under the FADP, you have the following rights against us. They cost nothing.

Visitors from the European Union have the same rights under the GDPR, plus the right to have processing restricted.
Get in touch by phone or in writing at {{EMAIL}}. Before we provide any information, we need to be sure it's really you. So expect a follow-up question. This is not distrust, but protection against the case that someone else is requesting your data.
If you are not satisfied with our response, in Switzerland you can contact the Federal Data Protection and Information Commissioner. In the European Union, the data protection authority of your country of residence is responsible.
Status of this policy
